Your Mufti will contact your spouse to hear their perspective and explore whether reconciliation is possible before moving forward.
After speaking with both parties, a decision will be made on whether we can take on the case. If we can, and you wish to proceed, the initial payment must be made before the case continues.
We always aim for reconciliation where possible. If it becomes clear that reconciliation cannot be achieved, the case moves to the next stage.
If reconciliation has not been achieved or is clearly not possible, the case enters formal review. The circumstances are assessed to decide the appropriate action. This may lead to a Talaq (husband-initiated), a Khula (wife-initiated with consent), or referral to the Shariah Panel for consideration of a Faskh (judicial dissolution).
Our senior Muftis review the complete case file and all evidence, then issue a judgement based on Islamic principles to decide whether a Faskh should be granted.
If the panel issues a Faskh, any remaining payments must be completed. The IICOJ Islamic Divorce Certificate and supporting documents are then prepared, signed, and stamped.
When all documentation is finished and verified, it is posted to both parties, and the case is officially completed.
Our process at IICOJ is simple and time-efficient. We completely disagree with unnecessary delays, costs and travels, and therefore we expedite the process with diligence, whilst maintaining efficiency.
Your application will be allocated to a Mufti and processed in the standard order of receipt. The average processing time is approximately 3 months, although this may vary depending on the nature and requirements of the case. Applicants will be updated at the appropriate stages of the process and whenever there is a material development. This service does not include continuous correspondence or regular requests for progress updates.
Your application will be allocated to a Mufti and given priority consideration in order to support earlier review and reduce avoidable administrative delay where possible. This service is intended to assist with faster progression, but it does not guarantee completion within a particular timeframe, as progress will depend on the circumstances of the case.
Your application will be allocated to a Mufti, with additional oversight from a senior Mufti, and will receive the highest level of priority. The case will also be subject to closer supervision and more regular review by the panel of Muftis in order to support more efficient progression where possible. This service is intended to help minimise avoidable delay, but it does not guarantee completion within a specific timeframe.
Following submission of the application, a complimentary consultation will be arranged. If the matter proceeds, 50% of the applicable fee is payable at that stage, with the remaining balance due upon completion of the case.
